The seminar came at a time of great change for the industry, only a month before the new 2016 Insolvency Rules finally come into force and replace the 1986 Insolvency Rules. Sam Fenwick led a presentation on some of the more significant changes that the new Rules are expected to make to insolvency practitioners’ day-to-day practices and ways in which professionals throughout the industry may need to adapt in the coming months.
The seminar also featured a presentation by Dr Karl Mackie, one of the most experienced mediators in commercial mediation practice. Karl provided the audience with a range of practical tips for breaking deadlocks in conflict situations and avoiding common pitfalls.
Mediation may have a larger role to play in resolving disputes in the context of insolvency industry, given the increased court fees and inability of litigants to recover success fees and insurance premiums from opponents.
