The government decided to amend the legislation in certain areas.
The amending legislation was the Collective Redundancies and Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014 or ‘CRATUPEAR’ as it is known in the trade (see Key points in new TUPE regulations for details).
In a rather surprising move, an early day motion is calling for its annulment, which now throws into doubt whether or not employers can safely rely on the new rules. The motion is unlikely to be passed but it does create uncertainty in what is already a very difficult area of law.
