The case of Punjab National Bank v Gosain has confirmed that secret covert recordings taken by an employee of his employer's private deliberations during a grievance and disciplinary hearing, is admissible evidence in an employment tribunal.

In this instance, the employer was alleged to have made inappropriate comments about the employee whilst she was out of the room which the employee secretly recorded.

The tribunal has to balance admissibility of relevant evidence against the public policy interest in preserving the confidentiality. Here the Tribunal got the balance right.
