UNISON has been granted permission to appeal the High Court's decision to dismiss its application for a judicial review of the introduction of fees in the employment tribunal. 

The union had argued before the High Court that the introduction of fees was in breach of EU law. The application was dismissed, primarily on the basis that it had been brought prematurely and that there was no evidence to support UNISON's claims.

However, as has been widely reported, the Ministry of Justice published tribunal statistics for October to December 2013 (the first full quarter since the introduction of employment tribunal fees).

The statistics showed nearly an 80% drop in employment tribunal claims compared to the equivalent period in 2012. UNISON has said it plans to ask the court to consider the statistics in deciding the appeal.
