I think in 20 years time the government of the day will hit on a couple of ideas to deal with the escalating public spending on court costs and to speed up the court process:

  1. Instead of the response pack which encourages all the litigants in person to defend, why not just send an acknowledgment of service form and then the defendant has 14 days to file a defence. If they don’t the claimant can obtain a judgment in default. Nice and simple and frees up the court time as it won’t have to deal with all these madcap defences or applications for summary judgment.
  2. To stop all these unrepresented litigants in person clogging up the courts, why not have a publicly funded legal advice scheme so that anyone can go to a solicitor and get legal advice subject to their means on any topic. This will help speed up the court process considerably.

They will wonder why previous generations never thought of this!
